The House and Senate are scheduled to return on September 14. While the Senate is scheduled to be in session through the rest of the month, the last voting day in the House is set for Thursday, September 17.

Congress:

• FY27 Appropriations: With the continuing resolution (CR) extending federal funding through December 11, 2026, Congress has until that date to reach a full-year appropriations agreement or enact another stopgap measure that extends into 2027. If Sen. Mitch McConnell (R-KY) returns from his absence next week, the Senate Appropriations Committee could resume work on its fiscal year (FY) 2027 spending bills and potentially advance additional markups before the end of the month. If not, Senate appropriators may instead consider outstanding appropriations bills during the lame-duck session in November and December.
• Reconciliation 3.0: Republican leadership reportedly remains hopeful that the Senate can adopt a budget resolution to unlock the process for passing a third reconciliation package. However, it remains unclear whether Senate Republicans will pursue a budget resolution so close to the 2026 midterm elections.

Trump Administration:

• HUD Circulates and Withdraws Plans for Reorganization: HUD issued a preview of its “notice of intent to reorganize” on September 4 in the Federal Register. However, later that day, HUD’s Office of General Counsel submitted a request for the document to be withdrawn and to cancel its formal publication. The draft reorganization withdrawal notice shows that HUD was planning to reorganize and consolidate many of the department’s components.
• Census Bureau Proposes Overhaul of 2030 Census: On September 9, the Census Bureau released a proposed rule that would move to exclude immigrants who are in the country illegally from the population totals used to determine political representation and not ask every American about their race and ethnicity.
• HUD Solicits Comments on Additional Incentives for CoC Program: On September 11, HUD issued a Notice of Research Justifying Additional Incentives for Certain Activities to Reduce Homelessness for the Continuum of Care (CoC) program in the Federal Register. HUD is seeking public comment on proposed activities to incentivize through the CoC program that help prevent or reduce homelessness. Comments are due by October 13, 2026.
• FTA Announces ASAP Grant Awards: On September 10, the Federal Transit Administration (FTA) announced approximately $233 million in funding for eight projects in five states through FTA’s All Stations Accessibility Program (ASAP).
• Appeals Court Finds IRS's Data Sharing with ICE Violated Law: On September 8, the U.S. Court of Appeals for the District of Columbia ruled that the Trump administration’s Internal Revenue Service (IRS) likely violated federal law by sharing confidential taxpayer information with Immigration and Customs Enforcement (ICE). The court found that the IRS improperly disclosed data based on partial addresses and failed to meet requirements limiting information sharing to criminal investigations.
