UPDATE: CMS Workplace Vaccination Rule Now Paused Nationwide

A Louisiana federal judge granted Tuesday a preliminary injunction in 40 states of the Centers for Medicaid and Medicare Services (CMS) rule requiring all workers in healthcare settings receiving CMS resources to be vaccinated against COVID-19.

The Louisiana court's preliminary injunction covers all but those 10 states impacted in the Missouri v. Biden injunction, which includes Alaska, Arkansas, Iowa, Kansas, Missouri, Nebraska, New Hampshire, North Dakota, South Dakota, and Wyoming. The ruling out of the U.S District Court for the Western District of Louisiana effectively pauses the rule's rollout nationwide.

The rule's first benchmark was scheduled to occur this coming Sunday, as workers would have been required to receive their first COVID vaccine dose no later than December 5.
